The website www.buska.io and the application app.buska.io (collectively, the "Service") are published by Fibroweb SAS, a simplified joint stock company (societe par actions simplifiee) with a share capital of 1 euro, registered with the Registre du Commerce et des Societes (RCS) of Grasse, France.

1. Definitions
- "Service": the Buska platform accessible at www.buska.io and app.buska.io, including all associated features, APIs, and integrations.
- "Client": any legal entity or professional acting in a business capacity that subscribes to or uses the Service.
- "User": any natural person who accesses or uses the Service on behalf of a Client.
- "Subscription": the paid plan selected by the Client, which may be Starter, Growth, Scale, or Agency.
- "Free Trial": the 7-day trial period offered to new Users at no cost and with no credit card required.
- "Content": any data, text, images, or information processed, stored, or displayed by the Service on behalf of the Client.
2. Service Description
Buska is a software-as-a-service (SaaS) social listening platform designed for B2B lead generation. The Service enables Clients to:
- Monitor over 30 social media platforms for mentions, buying intent signals, and relevant conversations.
- Leverage AI-powered lead scoring and qualification to identify high-value prospects.
- Integrate with CRM systems, outreach tools, and automation platforms via webhooks, native integrations, and a REST API.
- Access an MCP (Model Context Protocol) server for AI agent integration, subject to plan eligibility.
Fibroweb SAS reserves the right to update, modify, or discontinue any feature of the Service at any time. Material changes that reduce existing functionality will be communicated to active subscribers in advance.
3. Account Registration
To use the Service, Users must create an account by providing accurate, complete, and up-to-date information. Each User may maintain only one account per email address.
Users are solely responsible for maintaining the confidentiality of their account credentials, including their password. Any activity conducted through a User's account is deemed to be performed by that User.
Users must notify Fibroweb SAS immediately at hello@buska.io upon discovering any unauthorized access to or use of their account.
4. Free Trial
New Users are eligible for a one-time, 7-day free trial that provides full access to all features of the Service. No credit card is required to activate the free trial.
Each User is entitled to one free trial only, tracked by email address. Creating multiple accounts to obtain additional trial periods is prohibited and may result in account suspension.
At the end of the free trial, the account is locked until the User subscribes to a paid plan. All data generated during the trial period is preserved and will be accessible upon subscribing.
5. Subscription Plans and Pricing
The Service is available under the following plans:
- Starter: $49 per month or $490 per year. Includes 3 keywords, up to 50 leads per week, and 1 team member.
- Growth: $99 per month or $990 per year. Includes 10 keywords, up to 150 leads per week, and up to 5 team members.
- Scale: $249 per month or $2,490 per year. Includes 30 keywords, unlimited leads, and unlimited team members.
- Agency: custom pricing tailored to agency needs. Contact hello@buska.io for details.
Annual billing provides a discount equivalent to approximately two months of service. All prices are stated in United States dollars (USD) and are exclusive of any applicable taxes, which are the responsibility of the Client.
6. Payment Terms
Payments are processed securely via credit card through Stripe, our third-party payment processor. By subscribing, the Client authorizes Stripe to charge the designated payment method.
Subscriptions automatically renew at the end of each billing period (monthly or annually) unless canceled before the renewal date. Billing begins on the date the subscription is activated.
Annual subscriptions are billed in full at the time of purchase.
In the event of a failed payment, the Client will receive a notification and a 7-day grace period to update their payment information. If the payment issue is not resolved within this period, the Service may be suspended until payment is successfully processed.
7. Cancellation Policy
Clients may cancel their subscription at any time from their account settings or by sending a request to hello@buska.io.
Cancellation takes effect at the end of the current billing period. The Client retains full access to the Service until that date. No partial refunds are issued for unused time remaining within a billing period.
8. Refund Policy
7-day satisfaction guarantee: If you are not satisfied with the Service within the first 7 days of a new paid subscription, you may request a full refund by emailing hello@buska.io.
After the initial 7-day window, no refunds are issued for the current billing period.
For annual subscriptions, refund requests are accepted only within 7 days of the initial purchase date.
Subscription renewals (whether monthly or annual) are not eligible for refund. Clients should cancel their subscription before the renewal date to avoid being charged for the next billing period.
Approved refunds are processed via the original payment method and typically appear within 5 to 10 business days.
Free trial periods are not eligible for refund, as no charge is made during the trial.
9. Acceptable Use
The Service is intended for professional and business use only. By using the Service, the Client agrees not to:
- Resell, sublicense, or redistribute access to the Service without prior written authorization from Fibroweb SAS.
- Use the Service to send unsolicited messages (spam) or engage in any form of abusive outreach.
- Scrape, crawl, or extract data from the Service beyond the scope of authorized use as defined by the Client's subscription plan.
- Upload, store, or transmit any malware, viruses, or malicious code through the Service.
- Interfere with, disrupt, or attempt to gain unauthorized access to the Service, its infrastructure, or other users' accounts.
- Use the Service in any manner that violates the rights of third parties, including intellectual property rights and privacy rights.
Fibroweb SAS reserves the right to suspend or terminate accounts that violate these terms, with or without prior notice.
10. Intellectual Property
All elements of the Service, including but not limited to the software, user interface, design, branding, logos, documentation, and proprietary algorithms, are the exclusive property of Fibroweb SAS and are protected by applicable intellectual property laws.
The Client retains full ownership of all data and content uploaded to or generated within their account.
By using the Service, the Client grants Fibroweb SAS a limited, non-exclusive, non-transferable license to process the Client's data solely for the purpose of delivering and improving the Service.
11. Data Protection
Fibroweb SAS is committed to compliance with the General Data Protection Regulation (GDPR) and all other applicable data protection laws.

In the context of the Service, Fibroweb SAS acts as a data processor with respect to Client data and implements appropriate technical and organizational measures to ensure the security and confidentiality of such data.
12. API and Integration Terms
Access to the Buska API is subject to the limits defined by the Client's subscription plan. The Growth plan includes up to 500 API requests per month. The Scale plan includes up to 2,500 API requests per month.
API keys are confidential credentials and must not be shared with unauthorized parties. The Client is responsible for all activity performed using their API keys.
Rate limits are enforced to ensure fair use and platform stability. Excessive or abusive use of the API may result in temporary suspension of API access.
Webhooks and third-party integrations (including Slack, Discord, CRM connectors, and automation platforms) are provided on an "as-is" basis. Fibroweb SAS does not guarantee the availability or performance of third-party services.
Access to the MCP (Model Context Protocol) server is governed by the same terms and usage limits that apply to the REST API.
13. Service Level and Availability
Fibroweb SAS targets 99.9% uptime for the Service, excluding scheduled maintenance windows. Maintenance periods are communicated to Users in advance when reasonably possible.
Fibroweb SAS does not guarantee uninterrupted or error-free access to the Service. The Service depends in part on third-party social media platforms, and Fibroweb SAS is not liable for downtime, data unavailability, or degraded performance caused by changes to or outages of those third-party platforms.
14. Limitation of Liability
The Service is provided on an "as-is" and "as-available" basis, without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
To the maximum extent permitted by applicable law, Fibroweb SAS shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising out of or in connection with the use of the Service.
In all cases, the total aggregate liability of Fibroweb SAS for any claims arising under or related to these Terms shall not exceed the total amount of fees paid by the Client during the 12 months immediately preceding the event giving rise to the claim.
Fibroweb SAS is not responsible for the accuracy, completeness, or reliability of third-party data, including content retrieved from social media platforms.
15. Modifications to Terms
Fibroweb SAS reserves the right to modify these Terms of Service at any time. In the event of material changes, Users will be notified by email at the address associated with their account.
Continued use of the Service after notification of changes constitutes acceptance of the revised Terms. If a User does not agree to the updated Terms, they should discontinue use of the Service and cancel their subscription.

16. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of France. Any disputes arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the competent courts of Grasse, France.
